On Capitol Hill

Hectic, Politically Charged Legislative Session Ends, Transportation Fares Well
For many, the 2009 session of the 67th General Assembly was one of the most partisan and difficult in memory.  With 666 bills introduced, there were a number of historic debates and votes on highly controversial issues.  However, the CCA lobby team along with coalition partners, scored a number of significant victories.  CCA led the fight for an historic increase of dedicated road and bridge funding and helped to kill the most burdensome of the bills introduced. "CCA wants to thank it's lobby team for a great year," said Joseph O'Dea 2009 CCA President. "The net result of this session was positive for transportation funding."

The highlight of the year was the passage of SB 108 Colorado FASTER which will raise more than $250 million in dedicated funding for the repair of roads and bridges and provide additional transit funds state wide.  CCA was also a major player in making significant amendments to SB 228 which will eliminate the 6% General Fund spending limit as well as the transfers to transportation through SB 1 and HB 1310.  CCA and others, fought to amend the bill to in effect hold transportation funding harmless by earmarking about $170 million per year for transportation from FY 2012-13 through FY 2016-17.

Association News

Contractors Can Expect To See Increased Inspections by OSHA & EPA
This construction season contractors should expect visits by OSHA, EPA and the CDPHE on their sites but especially on ARRA Projects.  In the stimulus bill, there was $80,000,000 that was dedicated to increased attention by OSHA on ARRA Projects.  In conversations with OSHA, CCA has learned they are especially paying attention to special emphasizes areas such as Traffic Control and Excavations.  The new secretaries of Labor as well as the Acting Assistant Secretary for OSHA have increased OSHA enforcement as a priority although the Colorado OSHA Region sees value in continuing their outreach programs.  Contractors should monitor how their Traffic Control Subs are implementing their project’s Traffic Control plans and how knowledgeable their flaggers are on the principles of flagging.  Flaggers should always have plans for at least two escape paths.  In 2008 several CCA Members received citations by OSHA for traffic control as part of the multiemployer worksite regulation CFR 1910.

The Environmental Protection Agency, EPA, and the Colorado Department of Public Health and Environment, CDPHE, have both stated they plan to increase inspections on construction projects this year.  EPA is planning to conduct at least forty inspections this year.  As in past years these agencies will focus on Stormwater compliance.

Summer Jobs Interviews Cancelled
This year’s Summer Jobs Program Interviews, which was scheduled for Saturday, May 9th, has been cancelled.  CCA has applications from over twenty students from CSU-Ft. Collins, CSU-Pueblo, Colorado School of Mines and the University of Colorado-Boulder who are looking for a summer internships.  Several of these students have prior construction experience.  If your company is looking for some great talent to assist your project personnel or office staff this summer call Tristin at the CCA office (303) 290-6611, and ask her for the student applications.  CCA has received several calls from the AGC Student Chapter students who are willing and able to go to work this summer.

For those CCA members who are already enrolled in our CCA Healthtrust or if you are interested in our programming, the Employee Assistance Program (EAP) is offering a free webinar. The EAP webinar is for those supervisors, managers or HR people who assist those employees in your company who are in need of emotional support or are having difficulty in their work performance. The free webinar teaches you how to recognize, work with, engage in constructive confrontation and speak to those employees who are in need of emotional support offered through the EAP.

Contractors and the Current Economic Conditions
Construction has slowed down across the country.  In some sectors it’s worse than in others. Another Scam: Membership Directory Listing Application

After reports last September regarding a fraudulent Membership Directory Listing Application, they are at it again.  We believe that the fax is a SCAM.  Scam solicitations, like the one attached have once again begun to circulate.  Neither AGC of America nor our directory provider sent this fax.   We are in the process of trying to determine what organization sent the fax.  Please notify the AGC membership that this is not an AGC directory and should be careful in responding to the fax and providing money to this inquiry.  Click here to view the fax.

WANTED - Human Resources/Personnel Employees
The revitalized CCA’s Workforce Development Committee is looking to increase its membership. The committee is made up of employees whose responsibilities include human resources and personnel management.  Under the direction of the Committee’s new Chairman, Keith Gaertner, Concrete Express Inc., the committee is planning a strategy which will assist CCA Member Firms in maximizing their returns from their most important asset – their Employees.  Some of the committee’s responsibilities include developing new technical training classes, management and supervisory related seminars and investigating industry related problems and needs of the committee members.  H. Is Your Business Ready For The Flu Pandemic?
In November and December of 08 CCA published a series of short safety articles on natural and other disasters including pandemics and how CCA Members can plan for these disruptions.  The influenza, pandemic is here and businesses will play a key role in protecting your employees' health and safety as well as limiting the negative impact of the flu on your company, the economy and society. Planning for pandemic influenza is critical. Companies that provide critical infrastructure services, such as highway and water system repair, have a special responsibility to plan for continued operation in a crisis and should plan accordingly. As with any catastrophe, having a contingency plan is essential.

Community strategies that delay or reduce the impact of a pandemic (also called non-pharmaceutical interventions) may help reduce the spread of disease until a vaccine is available.

HHS and the Centers for Disease Control and Prevention have developed guidelines, including checklists, to assist businesses, industries, and other employers in planning for a pandemic outbreak as well as for other comparable catastrophes.

Bid Opportunities:  Stimulus Projects with USACE and Interior
The Army Corps of Engineers has released its list of Civil Works projects to be funded by the American Recovery and Reinvestment Act of 2009. The $4.6 billion is distributed in the following program accounts: Operation and Maintenance, Construction, Mississippi River and Tributaries, Formerly Utilized Sites Remedial Action Program, and Investigations.  The full list of projects can be accessed online by clicking here 

The U.S. Department of the Interior has published its complete project list which represents $750 million in Stimulus funds.  Projects include but are not limited to new buildings, to HVAC upgrades, energy efficiency projects, wastewater systems, hiking trails, fencing, photovoltaic systems, pipeline replacement, paving and roadwork.  Agencies under the jurisdiction of Interior include the Bureau of Reclamation, Bureau of Land Management, Bureau of Indian Affairs, U.S. Fish & Wildlife Service and the National Park Service.  For a complete listing of projects by State, click here.

CCA Members Invited to Constructability Review:  Edwards Interchange Upgrade – May 13
A constructability review meeting will be held in Denver at the CCA Office on Wednesday, May 13, 2009 at 9:00 am to discuss the Edwards Interchange Upgrade project.  The CCA office is located at 6880 South Yosemite Court, Suite 200, Centennial, CO 80112.  All interested members are welcome to attend. For a project description, click here. Changes to Design and Construction Project Support Website
CDOT has made modifications to the CDOT Design and Project Support website (click here) to incorporate new and revised special provisions that have been issued as of this date.  Please also note that a modification to the Minimum Wage Specification is being issued effective today.  The inclusion of the revised special provision is mandatory on federal-aid projects that have bid openings on or after May 11, 2009.  CDOT has also deleted two standard special provisions.  Revision of Section 106, Sampling and Testing of Portland Cement Concrete Pavement is being replaced with the new standard special, Revision of Sections 105 and 106, Conformity to the Contract of Portland Cement Concrete Pavement.  Revision of Section 630, Method of Handling Traffic is being replaced with the new standard special, Revision of Section 630, Transportation Management Plan.  The new and revised special provisions will be available at appropriate locations throughout the CDOT Design and Construction Project Support web site.

New OJT Requirements on Stimulus Projects
CDOT will be setting OJT goals on ARRA projects in compliance with their OJT Project Special Provision. Some projects are including special construction requirements that include additional job advertisements and the posting of job orders with the State Workforce Centers. There are some possible conflicts between the new requirements and the current OJT Special Provision and CCA is working with CDOT to resolve these issues.  Considering the financial penalties a contractor may receive if the OJT regulations are not fully met, CCA recommends all contractors should closely pay attention to their project OJT contract requirements especially on ARRA projects. CCA will continue to keep its members informed on the interpretations of these requirements in Friday Facts. Contractors who are awarded an ARRA Project are encouraged to contact Terry Kish, CCA’s Director of Safety and Workforce Development, for assistance in meeting these new requirements.  Click here for an example of the new project OJT requirements.

Construction on Rockies Express Pipeline to Start Soon
Construction will start soon on the 1,679-mile Rockies Express natural gas pipeline that will run from Colorado to Ohio. The $6.6 billion project originally faced some opposition from property owners. However, Rockies Express officials agreed to compensate them for the property the company will use for the pipeline. Officials say the project could be completed in November.  Record-Herald (Washington Court House, Ohio)(5/5)

Despite Today’s Disappointing Jobs Report, Associated General Contractors of America Finds Early Signs Stimulus is Putting Americans Back to Work
